Justiça: 2021 Report on Mexico’s Criminal Investigations Failures

Executive Summary

This report from Amnesty International reveals a trend in the failure of criminal investigations relative to femicides preceded by the disappearance in the state of Mexico. The inadequate procedures followed by officials, lack of proper application of a gender perspective, and loss of evidence contributed to the negligence in investigations. In the case where femicide has been determined per the state's legal definition, family members play a crucial role in the investigation process. They help to mobilize additional resources and advocate for justice for their loved ones. However, this also puts them at risk of becoming targets themselves, both by the perpetrators of the crime and, in some cases, by officials involved in the investigation. 

Amnesty International highlights three cases of femicide and one disappearance in which official shortcomings are evident. Nadia Muciño Márquez disappeared in east Mexico, killed in 2004. Daniela Sánchez Curiel vanished in 2015 and remains undiscovered; her family fears she may be a victim of femicide. Diana Velázquez Florencio disappeared and was killed in 2017. The fourth case, Julia Sosa Conde, disappeared and was killed in 2018. 

The research conducted demonstrates how the lack of appropriate investigation procedures for femicide and disappearances of women enables these crimes to go unpunished. In turn, Mexico is violating its obligation to investigate, ultimately infringing on victims' access to justice and judicial protection. In response, Amnesty International compiled a report on combating shortcomings in Mexico's justice system, including recommendations and policy implementations.
